Instructions : 1) Answerany eight questions from Q.No. 1 to 12.
2) Question No. 13 and 14 are compulsory.
1. Discuss the principle of Res Judicata under the provisions of the Civil Procedure
Code. '
2. What are foreign Judgments ? How can they be enforced by the Courts in India ?
3. Explain the provisions of the code dealing with appearance and non-appearance
of the parties in a suit.
4. What is a Representative suit ? Is it different from an ordinary suit ? Justify your.
answer. ?
5. Examine the effect of Death, Marriage and Insolvency of parties on the suit
which is being instituted in the Court.
6. Discuss pleadings. Can the pleadings be amended by the parties ? Give sufficient
reasons for your answer.
7. Explain the provisions of the Code with respect to suits by or against Minors and
persons of unsound mind.
8. Highlight the various grounds on which the power of reference could be exercised.
Also discuss the fundamental difference between reference and Revision.
9. Explain ?arrest and detention of the Judgement debtor? as a mode of execution of
a decree under the provisions of the Code.
_ 10. Discuss the provisions relating to First Appeal. What is the fundamental difference
between the First and the Second Appeal ?

and duties of the commissioner. ?
