Answer any TWO of the following questions:
- X owes Y a debt guaranteed by Z. Y does not sue X for a year after the debt has become payable and in the meantime X becomes insolvent. Is Z discharged from his liability?
- X, Y and Z carried on a business for profit but under special conditions as to Z that 'Z' was to contribute neither labor nor money and was not to receive any profits, but was to lend his name to the firm. Is Z liable for the debts of the firm? Decide.
- Ratnakar delivered his car to Mahesh for repairs. Mahesh completed the work, but did not return the car to Ratnakar. Ratnakar reminded Mahesh for the return of car. In the meantime a big fire occurred in the neighborhood and the car was destroyed. Decide whether Mahesh can be held liable under the provisions of Indian Contract Act, 1872.
- Mr. 'A' executes a promissory note in the form "I promise to pay a sum of Rs.50,000/- after three months." Decide with reasons whether the promissory note in the above case is a valid promissory note.
